On 26th of July 2012 the report „Issues and Assumption Paper for the Design of Upgrated Bank Resolution Framework” prepared by the World Bank mission under the leadership of John Pollner, Lead Financial Officer, Europe and Central Asia Region, in the cooperation with the Workgroup of Financial Stability Committee headed by Jerzy Pruski, President of BFG Management Board, will be presented in the premises of BFG.
The report has been prepared at the request of the Ministry of Finance under the World Bank’s program entitled Technical Advisory Work for the Government of Poland. It presents the analysis of the Polish solutions regarding bankruptcy and bank liquidation (included, among others, in the banking law and bankruptcy and reorganization law), which emerge from the last financial crisis experience. The solutions from the scope of bank resolution and restructuring in Poland have been proposed.
The necessity of the legislative amendments, which will enable conducting of bank liquidation process in orderly manner that protects depositors and stability of the financial system, was indicated in the report.
The newest propositions of the EU Commission published on 6th of June 2012, which were included in the project of the directive on composition of the legal frames for the recovery and resolution of the credit institutions and investment companies, have been also referred to in the report.
